Lawsuit option for Pre 26 June 2010 Applicants

Friends,

I have been saying this for a while now, that there are no options but to wait or re-apply for Pre June 2010 applicants. Most recent timelines suggest CIC takes more than 3 years to process the Pre June applications that were submitted as fast track applications under the 38 occupations list. Some of you have asked me about an appeal about the CIC processes etc., Few others have told me about their unfair rejections and application returns etc., Here is a link to one such lawsuit option for those of you to take it to the next level.

PS: Using this lawsuit option should be at the readers’ discretion. As usual, my suggestion is to re-apply for PR under the new streams for immigration.

    Hi Indira,
    I am also the one who had applied in the end of February 2010 as a fast track applicant through consultancy based in Canada itself and my lawyer even told me that my application was approved in July or August 2010. But, due to my brother application who was my dependent and he was below 20; the lawyer said it was taking quite a long time and then, later on I said let my brother application be in hold and just process mine only. Finally, he was able to apply my visa processing in Delhi on December 20th 2011 but, till now I have not heard any good news. The wait of this whole process was quite boar-dorm but, still I am doing is waiting. Last time it’s almost 2 to 3 weeks back my lawyer said they were reviewing my background check and my University was not responding well as the University is very dumb they don’t do things in time and don’t give proper information. Here, I would like to ask you how many months it might take maximum to get this whole process done or do the visa office even deny to give visa? even after the approval from CIC. Even I have not had the medical check up do I have to go through medical check up too? My consultancy people told me that medical check up could be done after reaching Canada too is this true or false?

    Please, give me the details. I would be thankful to you if you could answer my questions.

    1. I replied to your other query too. First none of your situation matches FSW. I do not know of other stream applciation timelines.

    I am a newcomer to your blog site. I am a doctor by profession. Applied for immigration to Canada in 2006. Didn’t receive any communication from CIC or NDVO. Was using the services of WWICS, Chandigarh. Now, at WWICS request, I reapplied on June 2010, received request for submitting full application (family included) by 6th Feb 2011, applied with all the requisite documents including PCC, Proof of fund, Income tax files of previous 3yrs, IELTS, me and my wife’s original experience certificates, etc on 5th Feb2011 thru WWICS. Now CIC website shows ALL PAPERS RECEIVED BY VISA OFFICE, New Delhi. This statement has been on display for more than one year now. I contacted them personally and asked them about various things including ways to scrap the application (2006) upon which they responded thru email. Now I have scrapped my agreement with WWICS, requested scrapping of my 2006 application and also requested them to contact me directly thru my email regarding my second application which they are doing nowadays.

    I am in a very peculiar situation now. Want to go for further studies but dont have all my papers; cannot change my job as well. I have appeared for MCCEE, results are awaited. CIC sent me a communication that my application is due for processing in 2012 but finalisation may not happen till 2013! Well, am I wasting my time and money here? I am not sure. Kindly enlighten a little bit. I am employed with Indraprastha Apollo Hospitals, Ltd. in the department of CTVS (Cardiac Surgery).

    1. Unsure which papers you dont have? Why can’t you change your job? Yes that batch of applications are taking longer to process, but you can always apply to study.

        Now, my application is IN PROCESS since 23 April 2012. CIC sent me an email last year that finalization will be at the end of 2012 or early 2013. So I should be waiting for the medical papers? How long does it take to process and receive the medicals, usually? I am tired of waiting and at the end of my tethers. Moreover I have passed MCCEE and would like to appear the next two exams which are held in Canada only. That is why I would like to land and go for them. Do you have any other suggestions? If so, kindly guide me.
